Halt Death Sentences Against Innocent Civilians in Egypt 

Statement by the African Commission on Human and Peoples’ Rights: 

On the 31st January 2018, the African Commission on Human and Peoples’ Rights has issued provisional measures under rule 98 of the Rules of Procedures of the African Commission on Human and Peoples’ Rights upon the request of Justice for Human Rights- JHR- in communication 569/17 filed on behalf of:

1- Ahmed Mustafa Ahmed Mohamed.

2- Ahmed Amin Ghazali.

3- Reda Mo’tamed Fahmi Abdel Monem.

4- Mohammed Fawzi Abdel Jawad Mahmoud.

5- Abdel Basir Abdel Raouf Abdel Mawla Hassan.

6- Mahmoud Al-Sherif Mahmoud Abdel Mawgod Goda).

The above mentioned  6 civilians were falsely accused and sentenced to death by West Cairo Military court on 29 May 2016 in case No. 174/2105.

It is worth mentioning that the aforementioned victims have been subjected to:

- Arbitrary detention by the State authorities.

- Enforced disappearance.

- No access to lawyers and families for a long time.

- Brutal torture to force them to confess to crimes. 

- Deprived of a fair trial as guaranteed by the Egyptian Constitution.

In light of the above, the African Commission on Human and Peoples’ Rights requested Egypt to suspend the death sentences against the victims pending the determination of the communication by the Commission.

Consequently, JHR calls on the Egyptian Authorities to:

Urgently halt the implementation of the death sentence issued on 29 May 2016 by West Cairo Military court in case No. 174/2105 against the aforementioned six civilians for being innocents pending the determination of the communication 569/17 by the African Commission according to the commitment of Egypt to the cause of human rights, including through its ratification of the African Charter.
