Egypt"s State Court rejected the appeal submitted by Ayman Nour, previous leader of Al-Ghad Party, against the attorney general in which he demands overturning the Administrative court"s ruling of denying him a release for health reasons. The State Court dismissed Ayman Nour"s appeal in the session held on Tuesday, Feb, 5th, 2008, seeing as not serious the reasons that Nour listed in his appeal demanding his release for health reasons and saw that all his arguments aren"t sufficient to back a release for health reasons .

It is worth mentioning that the report of the State Court, drafted by judge Abdul Qader Qandil, the deputy chief justice of the State Council, stipulated that a release for health reasons for prisoners can be carried out when the patient has a life-threatening disease or a diseases that causes a full disability provided that there is any of the following two reasons:

First: That the prison sentences threatens the life of the prisoner or causes a full disability. However, the report of the medical committee- formed of a number of forensic doctors- proved that Ayman Nour"s serving his prison sentence does not constitute any danger on his life and doesn"t cause him any full disability. This is because he may face the complications that he faces because of his disease inside prison, outside prison as well.

According to this medical report, the state Court saw that this report proves that Nour"s reasons for demanding a release have no legal foundation ant that the diseases that he suffer from have no relation with his prison or release. The deciding of the country deputies advised in the end with the refusal of a stabbing " Ayman Nour " leaning on the non presence of serious reasons based on it the stabbing .

The report recommended that Nour"s appeal be rejected because it has no serioys bases. For its part, the State Court decided to adjourn seeing Nour"s appeal till Feb, 18th, 2008, to see report.
