Palestinian resistance factions should forge a truce agreement with Israel according to the deal inked in April 1996 between Israel and Lebanese Hizbullah, said international law expert in statements to Ikhwanweb.

Judge Hassan Omar called on Palestinian resistance factions to forge a truce agreement with Israel according to deal inked in April 1996 between Israel and Lebanese Hizbullah.

Calling the Palestinian prisoners "kidnapped Palestinian hostages, Omar a deal should be inked over a swap between the kidnapped Palestinian hostages in return for releasing Israeli soldier Gilad Shalit provided that the latter is handed over to French government on a mercenary status and to face a trial according to this status. This is due to the fact that international conventions ban using mercenaries in fighting national liberation powers.

Regarding Jordanian parliament"s decision of suing Israel in front of the International Criminal Court, judge Omar said Jordan can do so because it is a signatory to the Roma Statute of the International Criminal Court. As for Israel, it isn"t a signatory to the Statute of the International Criminal Court but there are three exceptions that authorize the International Criminal Court to bring Israel to justice:" First: The aggression on UN enterprises and agencies (this happened when Israel launched strikes on UNRWA headquarters and stores second: UN resolution no.
3103 concerning rights of resisters and fighters rights and Third: Banning using mercenaries against national liberation powers in provinces that don"t enjoy autonomy (Israel used mercenaries in its war on Gaza Strip.

Judge Omar warned the United Nations against not taking necessary measures as it is responsible for implementing Geneva Conventions. "This makes UN Secretary-General Ban Ki-Moon and Luis Moreno-Ocampo, prosecutor of the International Criminal Court held accountable and may be sued unless they take the necessary measures toward the aggression and massacres committed in Gaza Strip", he said
