Egypt : Administrative Court Reviews The Case of The Right to Demonstrate

 The Arabic Network for Human Rights Information today said that the administrative court reviews tomorrow the case filed by 3 Egyptian young men in the twenties of age to bind Cairo Head of security to respect the law and the constitution and allow a peaceful demonstration that they were planning to stage in protest of the continued emergency state. So far, the three young men have spent their entire lives under emergency state imposed on Egypt since 30 years. The case is challenging the decision of Cairo Head of security to refuse the demonstration.

On 3/4/2010, the three Egyptians are , Mohamed Adel , Ahmed Maher and Omar Mubarak have sent sent the legal notice # 2636/2010 to Cairo Head of security notifying him of a peaceful demonstration to be staged on 6/4/2010 in protest of extending the emergency state. However , the Cairo Head of security sent a legal warning refusing the demonstration claiming that it will “ disturb public peace” .

In respect to the law and despite that the constitution and the law #14/1923 state that citizens should notify security and not take permission to stage peaceful assemblies , the three young men filed a case before the administrative court to compel Cairo Head of security to respect the law ,as his decision to refuse the demonstration is illegal and an assault to the public right to express.

Despite that the parliament have approved the extension of the emergency state ,Egyptian youth and and ANHRI lawyers insist on enjoying their right to expression and their right to peaceful assembly , resisting the encroachment of the ministry of interior on the public freedoms and rights.
